Terms and Conditions
Please, find the main changes effective 1st of January 2017:
- You will notice a price increase in our product range of 5 to 10% depending on the supplier of the materials and products. If you are interested in ordering some of our products, please, call us directly as prices currently on our website are in the process of updating and may not be entirely accurate.
- We no longer accept retention to be deducted on projects below 5’000(+VAT) and projects where we are engaged in renovation existing wooden floors. This is only applicable to all contractors that are subcontracting NS Parquet Ltd.
- Discounts of 5-10% would only be offered to clients placing orders on Supply & Fit basis for a quantity of more than 1 palette for each product ordered irrespective of product type (parquet or planks).
- As usual, if we are engaged in a Supply & Fit project we will provide one survey free of charge. There will be a charge for further surveys. This is only applicable to retail clients.
- The 5-7% commission we pay to all our associates/varies to Ltds and private clients ,call for details / will now be calculated on the NET amount of the projects and will be valid for all orders on Supply & Fit basis only and for supply orders of above £4,500 (NET).
- To keep our cash flow optimized we request, as noted in our T&C, all completed projects to be fully settled
- in advance for all retail-based orders
- within 7 working days for all Supply & Fit projects
- We are now happy to announce a 5% overall discount for all projects fully paid in advance as a partial relief for all our clients whose orders are placed on Supply & Fit basis.
- All products installed by us will receive a Guarantee as follows:
- all solid products – 5 years
- engineered oak parquet 14/90/400 – 5 years
- all other engineered planks and parquet – 3 years
- The Company reserves the right to revise prices and details displayed without notice due to the fluctuating market conditions mentioned above. Listed prices do not constitute a final offer until the company has accepted the buyer’s order or deposit. Validation of all quotes will be within 28 days as before.
‘Order’means the purchase order, either verbal or written, given by the Buyer to the Company to contract for Goods under these conditions of sale.
‘Contract’ means a legal binding agreement whereby the Buyer agrees to purchase Goods from the Company as detailed on the Company’s Quote, Invoice, Order form and/or website.
‘Buyer’ herein shall include the buyer, hirer, lessee, owner or any other person who is in charge of goods supplied by the company. ‘Goods’, shall include materials, equipment, spare parts and any other item supplied, serviced, repaired, loaned or hired by the Company.
Prices and delivery charges are quoted by the Company in Sterling exclusive of VAT. The price of goods to be paid by the Buyer to the Company is as listed on the Company’s Quote, Invoice, Order form, displays and/or website. The Company reserves the right to revise prices and details displayed without notice. Listed prices do not constitute an offer until the Company has accepted the Buyers Order.Charges for goods supplied by the Company shall be paid in full before delivery. Charges for bespoke goods manufactured and supplied by the Company shall be paid in full before manufacture. The price payable for goods ordered is set out on our website and in the showroom at the time of ordering. Upon agreement of contract between the buyer and the company, these prices are nonnegotiable.
Payment may be made by Bank transfer, Cash, MasterCard, Visa and Maestro at the time of Order. Cleared payment for all goods must be received prior to goods being dispatched. For special Orders and made to order Goods, cleared payment must be received prior to the commencement of production. The final payment (for each project) needs to be done within seven days ones the very final coat is applied! If there are circumstances preventing job to be completed in full /caused by other contractors or client itself /Wood Flooring Sales is in position to request/ demand payments to be received/as per T%C/ for all the work/material and labor involved in the project by the time job is suspended for some reason. Any costs of freight, carriage, insurance, installation and/or applying the Goods Ordered by the Buyer are not included within the price, unless otherwise specifically stated in the quotation or order form. The Company reserves the right to claim legal fees and any other costs as a result of the Buyers failure to pay. All online transactions are carried out over a secure Internet connection (HTTPS) utilising Secure Socket Layers (SSL) and Buyer details are encrypted whilst in transit and cannot be read. In addition, the Company does not store Buyer credit card details.
The property in and title to goods supplied by the company shall remain within the company until:
- a) The buyer shall have paid the price in full (plus VAT)
- b) No other sums whatever shall be due from the buyer to the seller
Acceptance of Order
All quotations by the Company are subject to acceptance by the Company within 28 days. Orders are accepted as a Contract at the sole discretion of the Company and together with these terms and conditions constitute the entire and only agreement between the Company and Buyer in relation thereto. The Company’s acceptance of the Buyer’s order by delivery/release of the Goods constitutes a legally binding Contract based on these terms and conditions. Any additional or amending terms or condition shall be ineffective unless one of the Company Directors expressly assents to the same in writing and endorses the same on the face hereof. Any cancellation or suspension of an order by the Buyer without the Company’s consent shall be on the condition that the Buyer shall indemnify the Company against any loss incurred wholly or in part by the cancellation or suspension. The Company reserves the right to sub-contract all or any part of the Contract for the manufacture, supply, installation and/or finishing of Goods.
It is the responsibility of the buyer to examine goods supplied by the company and to identify defects in materials and/or workmanship which might cause damage or injury. No claims for damages or discrepancies can be made after installation of our materials constitutes acceptance of the product in its current state. While the company endeavors to hold sufficient stock to meet all orders. If an insufficient stock is held or the stock item has been discontinued, the company may offer a substituted product and provide a sample for confirmation of acceptance.
Installation, Storage, Application
Where assembly of the goods supplied by the company is not undertaken by the company the buyer shall be responsible for assembly in accordance with the company’s instructions and shall ensure that such instructions have been obtained from the company. Failure to assemble goods in the manner prescribed in the instructions supplied with goods will invalidate the Company’s responsibility for damage caused to or by the goods.
Once delivered, the Goods should be stored appropriately in dry conditions at all times. The Company accepts no responsibility whatsoever for Goods installed or applied in new or renovated buildings which have not adequately dried out. The Company will also take no responsibility for any Goods subject to excessive heat, cold, damp or humidity, ether in suit or storage. The Company accepts no liability whatsoever for any issues relating to the installation or application of the Goods, unless the Buyer Contracts with the Company directly for such service. Please be informed if you fail to attend on delivery or postpone collection of your material as agreed you will be charged £100 for that. Some additional charges will apply if there is other transport/freight company involved and payments are already made from us. You also will be charged for extended use of our premises if we have no special agreement for extended usage. Where installation or application of Goods is not undertaken by the Company, the Buyer shall be responsible for installing or applying the Goods in accordance with the Company’s guidelines, a copy of which is available on the Company’s website, and shall ensure that such guidelines have been obtained from the Company. Failure to install or apply the Goods in the manner prescribed will invalidate the Company’s responsibility for damage caused to or by the Goods. However, no warranty is offered or implied by the guidelines as to the suitability of the Goods for any specific purpose. The Company also excludes any liability for referring floor installers and/or other trades and any dispute over quality of workmanship will remain between the Buyer and fitter/contractor and not the Company. NS Parquet is in position to refuse / cancel installation if there are building companies working on the same site, this is due to avoid /other people, activities, contractors or third part companies / from possible issues that can compromise installation and the quality of our products and performance!
In terms of delivery /storage Ns parquet, offer to all customers 2 weeks free of charge storage.Keeping your products for more than 2 weeks will affect with some extra costs once floor product is released from our premises./calculation are based on rent we pay to the owner of the premises/.For more details please call us.
Advice, information, and opinion given by any employee or agent of the Company are given without legal responsibility. Any recommendations or suggestions made relating to the use of Goods, whether in technical literature or in response to a specific inquiry is made in good faith, but it is for the Buyer to satisfy himself/herself of the suitability of the Goods for their particular purpose, and shall be deemed to have done so. The Company will not be held liable for any damages, liability or costs incurred from any independent arbitration arising from verbal recommendations or referral of floor installers and/or other trades by any employee or agent of the Company.
Claims &Limit of liability
It is the Buyers responsibility to inspect all Goods upon delivery and prior to the commencement of any installation or application work, as no complaints will be considered, and no right of return or refund for Goods will exist once the Goods have been unpacked, installed or applied, used or altered in any way whatsoever. Any claims of non-delivery, damaged delivery, incorrect quantity or any other alleged defects shall be notified by the Buyer to the Company through phone or email immediately on receipt of Goods and before installation or application has commenced. The Buyer shall send the full written particulars of the claim to the Company’s trading address within 7 days following delivery and before installation has commenced. Upon receipt of notice the Company will contact the Buyer to arrange for the return of the Goods, or part thereof, for examination by the Company. If, in the company’s opinion, the Goods are defective, the Company shall as its option replace with similar Goods or repair any defective Goods. All Goods claimed for must be returned to the Company in the same condition received before credit can be evaluated or new Goods are dispatched. In the event that the Company does NOT agree the Goods to be defective, then the Buyer will be liable for all carriage costs incurred through collection and return to Buyer. Settlement of any claim will be limited to the value of the Goods. The Company shall not be liable for damage or injury caused by its goods or workmanship beyond replacement of goods or work verification of the buyer’s complaint. The company shall not be liable for any consequential loss caused by its failure or delay in supplying, servicing or repairing goods, whether the loss arises from the actions or from the omissions of the company, its employees, agents or subcontractors.
Deliveries are generally made between 8 am and 6 pm Monday to Friday (excluding bank holidays). Every effort will be made to effect delivery within the quoted period, but no liability can be accepted should it be exceeded. For this reason, we are unable to accept responsibility for lost working time and recommend goods are ordered well in advance of any project start dates. The Company reserves the right to deliver by installments. It is the Buyer’s responsibility to ensure that the Goods can be delivered to the address provided during the order process. The buyer shall be at all times responsible for any additional costs incurred whatsoever as a result of deliveries being delayed due to access or unloading problems or delivery not accepted. The Buyer shall inspect all Goods on delivery. No claim of short delivery can be entertained unless signified at the time of delivery. Paint deliveries will be made by currier to the buyer’s address. All other goods may require assistance to offload and due to insurance restrictions are made to kerbside only so Buyers will need to arrange for help on the day.
Return Policy and Order Cancellation:
All returns of flooring purchased from us, as well returns of online flooring sales made after 7 days of delivery are subject to 30% re-stocking charge plus all transport cost generated. Goods must be returned to us in good saleable condition and in their original wrappers. Prior to returning the goods, please obtain a returns number from our dispatch department and mark this clearly on the label. Cancellations must be made in writing, this includes a letter, fax or email. Goods which have been custom made to your specification cannot be canceled (regulation 13 DSR 2000).No credit can be issued unless agreed returned Goods are deemed to be not faulty, are in the same condition, quantity and packaging as supplied and are fit for purpose. Refunds will be processed within 30 days of the Buyer notifying the Company of the intention to return a product/s and will be made in the same method as payment.
The Buyer may cancel an Order at any time prior to dispatch of the goods by notifying the Company. In the case of special orders or made to order products, the Buyer must request to cancel the order before the manufacturing of such products has commenced.
Guarantees given shall not be applicable outside the UK unless expressly stated otherwise by the company in writing. Any guarantees given will be invalidated if the goods supplied by the company are subject to misuse or accidental damage after the buyer had taken delivery of them.
It is advisable that you do not book a flooring fitter until you have had the delivery of the goods to ensure your wood is left to acclimatize. Damage caused to and by goods which are fitted without consideration for acclimatization cannot be compensated for by the company.
Drawings, photographs, part numbers, layout, and style are considered the property of the company. Reproduction in whole or in part is strictly prohibited without written permission. Quantities and measurements are approximate. Trademarks are acknowledged as being the property of their registered owners. Exact products may vary from that shown; all products are subject to availability. Goods are not sold on a trial basis. Owing to the nature of digital photography and other such media, the products shown on this website and in any accompanying media may differ slightly in proportion and color due to limitations of browser software and monitors. Our products are derived from natural sources and so are subject to natural variations in colour, shade and general appearance. In some cases there maybe sap wood.
